Permissible use

Last updated

Contact data is useful because it is powerful, and it is regulated for the same reason. Before your first order you accept the statements below. They are the whole of what we ask, and they are not boilerplate — we enforce them.

Why this exists

Telephone and address data of the kind returned here is governed by several overlapping regimes: the Gramm-Leach-Bliley Act for financial-institution data, the Driver's Privacy Protection Act for motor-vehicle data, the Fair Credit Reporting Act for anything used in an eligibility decision, and the Telephone Consumer Protection Act for what you do with a number once you have it. Our licence to supply the data depends on every customer having a permissible purpose, so the attestation is a condition of the service rather than a formality.

What you are accepting

I have a lawful business purpose for every record

I am requesting contact information in connection with a legitimate business transaction I am party to or pursuing — typically identifying and contacting a property owner about their property. I will not submit records out of curiosity, on someone else's behalf without their authority, or to locate a person for a personal reason.

I will not use this as a consumer report

I will not use the data, in whole or in part, to decide anyone's eligibility for credit, insurance, employment, housing, tenancy, or any other purpose covered by the Fair Credit Reporting Act. This service is not a consumer reporting agency and the data is not a consumer report.

I am responsible for TCPA and do-not-call compliance

Before calling or texting any number returned to me, I will scrub against the federal and applicable state do-not-call registries and my own internal do-not-call list, observe permitted calling hours in the recipient's time zone, honour every opt-out immediately, and obtain any consent the law requires for automated dialing, prerecorded messages or marketing texts. A phone number returned by this service is not consent to be contacted, and I accept sole responsibility for what I send.

I will not resell or redistribute the data

The returned data is licensed to me for my own business use. I will not sell it, publish it, sublicense it, post it publicly, or use it to build or enrich a data product, list or database offered to others.

I will not use it to harm anyone

I will not use the data to stalk, harass, threaten, intimidate or defraud any person, or to locate someone who has sought to avoid contact, including anyone protected by a restraining or protective order.

I will protect what I receive

I will keep the returned data secure, restrict it to people in my business who need it for the same lawful purpose, and delete it when that purpose ends.

I accept the consequences of being wrong about this

I understand that a false statement here may end my account without refund of unprocessed orders, and that I am liable for my own misuse of the data, including any penalty assessed against me under the TCPA or equivalent state law.

What this service is not

  • It is not a consumer reporting agency, and the data is not a consumer report under the FCRA. It may not be used for credit, insurance, employment, housing or tenant screening.
  • It is not a people-search or background-check product for personal use.
  • It is not a source of verified consent for calls or texts. Consent is yours to obtain and to prove.
  • It is not a guarantee of accuracy. Contact data ages, and people move, change numbers and share names.

How this is enforced

Acceptance is recorded once against your account, with a timestamp, and no order can be created before it. If we have reasonable grounds to believe an account is breaching these terms — including a report from a person contacted using data we supplied — we may suspend it immediately, refund unprocessed orders, and decline to serve it again. Where the law requires it, we will cooperate with an investigation.

Reporting misuse

If you believe data supplied through Skipmatch has been used against you, write to support@skipmatch.com with whatever detail you have. We will investigate, tell you what we hold, and act on what we find.
