Terms of service

Last updated

These terms cover your use of Skipmatch. They are written to be read, not to be survived. If something here is unclear, write to us before you order.

1. Who you are contracting with

Skipmatch ("we", "us") provides a contact-data lookup service for business customers. By creating an account or placing an order you accept these terms on behalf of yourself and any business you are acting for. You must be at least 18 and using the service for a lawful business purpose.

2. What the service does

You upload a list of property or owner records, or enter a single record. We submit those records to a licensed data partner, which returns telephone numbers, line types and, where available, email addresses associated with the identifying information you supplied. We return that result to you as a file.

We do not verify that a returned number belongs to the person you had in mind, that it is currently in service, or that the person will answer it. Contact data ages. Treat the result as a lead, not a fact.

3. Pricing, payment and refunds

  • List orders are $0.03 a record. The quoted total is shown before you pay and fixed at checkout.
  • Pay by card or prepaid credit. At checkout we place a hold for the quoted amount on your card through our payment processor, or reserve that amount from your available credit. Credit must cover the full quote. We never see or store your card details.
  • We charge only for matches when your file is delivered, at the per-record rate shown, and the rest of the card hold is released or reserved credit is returned to your balance. A record that returned no phone number and no email address is never charged, and neither is a record already in your history that came back with nothing new. Your order page shows the payment source, the final charge and the amount released or returned.
  • Minimum charge $0.50 when any record matches. If the matched records in an order come to less than $0.50, the final charge is $0.50; if nothing in the order is billable, nothing is charged.
  • If an order fails before delivery for any reason on our side, the unsettled card hold is released or reserved credit is returned and nothing is charged. Contact us if the hold is still on your statement after ten business days.
  • Single search: $0.10, charged only on a match, paid from prepaid credit ($10 minimum top-up). Credit packs of $10, $25, $50, $100, $250, $500 or $1,000 are charged to your card when you buy them; they are not a hold. A single search sets aside $0.10 of your credit when you place it. If the record matches, that $0.10 is used; if it does not match, or the search cannot be completed, it goes back to your balance. No card is charged for a single search itself. Prepaid credit can also pay for list orders at $0.03 a record. The full quote is set aside when you place the list order; billable records use that credit and the rest returns to your balance.
  • Prepaid credit expires 12 months after your last credit purchase, single search or credit-paid list, and unused credit is refundable on request within 90 days of purchase. Bonus credit has no cash value, expires with your other credit, and is removed if the purchase it came with is refunded. To ask for a refund, write to support@skipmatch.com within 90 days of the purchase; the unused part of that purchase is returned to the card it was paid with. Credit that has expired, or a purchase older than 90 days, is not refundable.
  • Matched records are not refundable. Not liking the number that came back is not a matching failure, and re-running the same list will return the same data.

4. Your obligations

You must have a lawful purpose for every record you submit and for every use you make of what comes back. The permissible-use terms are part of this agreement, and you accept them once before your first order. In short, and without limiting that page:

  • You may not use the data to make an eligibility decision about credit, insurance, employment, housing or tenancy. This is not a consumer report and we are not a consumer reporting agency.
  • You are solely responsible for complying with the Telephone Consumer Protection Act, state telemarketing and texting law, and the federal and state do-not-call registries before you contact anyone.
  • You may not resell, republish, sublicense or redistribute the returned data as a data product, or use it to build one.
  • You may not use the service to locate, harass, stalk or intimidate any individual.

5. Your files and your data

You keep ownership of the lists you upload. You grant us only the licence needed to run your order: to store the file, transmit the identifying fields to our data partner, and return the result to you. How long we keep it, and how to have it deleted, is set out in the privacy policy.

6. Availability

We do not promise the service will be uninterrupted. Orders are processed in the order they are paid for. Delivery times quoted anywhere on this site are estimates based on ordinary conditions, not guarantees, and a missed estimate is not by itself a failed order.

7. Limits on our liability

The service is provided as-is. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we are not liable for indirect or consequential loss, lost profits, or lost business opportunity.

Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot lawfully be limited.

8. Indemnity

You will indemnify us against claims, penalties and costs arising from your use of the data, including any claim under the TCPA or equivalent state law brought because of a call or message you sent.

9. Suspension and termination

We may suspend or close an account that breaches these terms or the permissible-use terms, that we reasonably believe is being used unlawfully, or that our data partner requires us to stop serving. The hold on any unprocessed order is released when we do so. You can close your account at any time by writing to us.

10. Changes

We may update these terms. Material changes will be notified by email to the address on your account, and take effect for orders placed after the notice. The date at the top of this page always reflects the current version.

11. Governing law and contact

These terms are governed by the law of the State of Delaware, where Skipmatch LLC is organized, and the courts of that state have exclusive jurisdiction. Questions go to support@skipmatch.com.
